  1. Introduction

Unless otherwise specified, this Privacy Policy applies to all products, services, websites and applications offered by Vo medias SAS, the owner of Vo post

We refer to these products, services, websites and applications collectively as “Services” in this Policy.

Any reference to “data” in this Privacy Policy refers to data that you collect through our Services, whether it is questionnaire responses, form data, or data embedded in a site that we host: all of it is yours!

Any reference to personal information or simply to information refers to information about you personally that we collect or for which we act as custodian.

2.1. What does « you » mean ?

We often refer to « you » in this Privacy Policy. In order to better understand which information best fits your profile, please refer to the helpful definitions below.

  1. Vo Media Users

You hold an account for a VoMedia service, and you create VoMediannaires, forms, applications or questionnaires directly or collaborate on, comment on or review them via an account.

  1. Respondents to a VoMediaNary

You have received a Vo Mediannaire, a form, an application or a questionnaire optimized by a Vo Media service.

  1. Visitor of the website

You are visiting one of our websites only out of curiosity !

2.2. The information we collect about you

  1. Contact information (by your e-mail address)

You may provide us with your contact information by using our services, in a form on our website, in an exchange with a member of our sales or customer service team, or by responding to one of our own Vo Mediasnnaire.

  1. Usage Information

We collect usage information about you when you interact with our Websites and Services. This includes the web pages you visit, what you click on, when you click, your choice of language and so on.

  1. Device and Browser Data

We collect information about the device and application you use to access our Services. By “data about your device”, we mean primarily your IP address, operating system version, device type, device ID, MAC address, system and performance information, and browser type. If you access our Services from a mobile device, we also collect the Universal Unique Identifier (UUID) for that device.

  1. Page tag information

We use cookies and tracking services provided by us and third parties that use cookies and page tags (also known as Internet tags) to collect data about visitors to our websites. This data includes usage and other user statistics. Emails sent by Vo Medias or users through our Services also contain page tags that allow the sender to identify users who have opened such emails or clicked on links contained within them.   1. Log Data

Like most sites today, our web servers maintain log files that record data each time a device accesses these servers. The log files contain information about the nature of each such access, including the IP addresses of the originating devices, Internet service providers, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system versions, device type, and timestamps.

If you come to a Vo Media site from an external source (such as a link on another website or in an e-mail), we record information about the source that referred you to us.

  1. Information from third parties and integration partners

We collect your personal information from third parties, for example, if you authorize them to communicate this information to us or if you have made it publicly available online.

If you are a Survey Creator, we also collect :

  1. Information collected during registration

You need a Vo Media account in order to use Vo Media Services. When you register for an account, we collect your first and last name, username, password and email address.

  1. Billing Information

If you make a payment to Vo Medias, we require that you provide your billing information, a name, address, email address and financial information corresponding to the payment method you have chosen (e.g. a credit card number and its expiration date or a bank account number). If you provide a billing address, we will consider this to be the location of the account holder for the purpose of determining any VAT that may be applicable to your purchase.

You can set different preferences and personal data on pages such as your account settings page. For example, your default language.

If you use some of our Services, we will therefore also collect the following information for your account:

We store your Vo Mediasnnaire / form / application data (questions and answers) for you and provide you with analysis tools related to this data.

When you register for our Services, you are invited to provide us with information about yourself and to give us more details about your profile.

3.1. Creators

We process personal data concerning you with your consent or for the purpose of :

  • fulfill our contractual responsibility to provide the Services to you ;
  • promote the legitimate interests of Vo Medias in terms of:
    • improvement of the service experience ;
    • development of new products and new functionalities of the services.

For each case where we describe our use of your data in this Privacy Policy, we have identified the bases that justify our processing of this data.

You have given us permission to use certain types of tracking and third-party cookies on our websites. We use in particular:

We may also use this technology to enable Creators to measure the performance of their email, and to help them improve their delivery strategy and open rates.

More specifically: the above data and techniques are used to personalize our marketing content, for analysis and other related activities. Learn more about targeted advertising and how to unsubscribe. We use this data to customize our online marketing campaigns based on your profile and your interests in our Services. By disabling cookies in your browser settings, you will no longer receive personalized messages but will continue to see Internet advertising unrelated to the information you have submitted to Vo Medias.

We process your personal information in the following categories of data according to our legitimate interests, which are described in detail in this Privacy Policy. We are committed to imposing clearly defined limits on each of these uses in order to ensure that your privacy is respected and that the information is used only for the purpose of achieving these legitimate goals. Our primary objective is to improve our Services and messages and to ensure that they are tailored to the profile of each of our users. We also intend to ensure that the personal information of all users is respected and protected.

  1. Contact information

We use contact information to respond to your requests, to send you information as part of the Services and to send you marketing information (as long as you maintain your registration).

Specifically: We use your email address to send you marketing messages (newsletters), unless you have opted out of this content and receive general updates to your account. You may unsubscribe from our marketing emails at any time by clicking on the “Unsubscribe” link inside and changing the appropriate settings on the My Account page.

  1. Your Use of Our Services

We use information about your use of our Services in order to improve the services we provide to you and to all users.

Specifically: We collect information about the types of surveys/forms/requests you create (e.g. HR surveys), the types of subscriptions you take out and the transactions you perform on your account in order to establish your profile and to provide you (and your organization) with other features or Services from our offering that may be of interest to you, and to advise you on how to use and optimize those Services.

  1. Device and Browser Data

We use device data to solve problems encountered with our service and to improve it. We also deduce your geographic location from your IP address.

Specifically: we collect this data to enable us to improve your service experience on a particular device/browser by optimizing the display of the website on a specific browser, and to ensure that the service works properly and optimally on different devices and browsers.

  1. Log Data

We use log data for a variety of commercial purposes, including :

  • to monitor abuse and troubleshoot ;
  • to create new services, new features, new content, or to make recommendations ;
  • to track behavior at the aggregate/anonymous level, and to identify and understand trends in various interactions with our Services ;
  • to fix bugs and repair product functionality.

More specifically: your IP address is used to identify any unknown/unauthorized access to your account (abuse monitoring).

  1. Service Uses and Marketing
  • Profiling: We combine information about you from third parties with information in our possession to create a user profile. This profile will allow us to optimize the relevance of our sales and marketing actions so that they are better suited to you, and we can personalize and improve your service experience.
  • Machine Learning: We use machine learning techniques on certain data in order to provide users with useful statistics and more relevant analysis of the data they have collected through our Services, to optimize our marketing campaigns and to detect fraud. For example, if you have used open-ended questions (with text input) in a survey, our survey analysis tool can provide you with actionable information about response trends for that type of question.

To administer our Services, we will also use your information and data internally for the following purposes:

  • to enforce our agreements where applicable ;
  • to prevent potentially illegal activities ;
  • to detect and prevent unwanted or abusive activity. For example, we have automated systems that scan content for phishing, spam and fraud.
  1. Lawful Uses

In order to respond to legal requests or prevent fraud, we may use and disclose information or data that we hold about you. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how we respond.

We collect and use the following to the extent we need to in order to fulfill our contract with you:

  1. Your account information

We must use your account information to operate your account, provide Services to you, bill you for our Services, provide customer support services, and contact you regarding your Service or account. We occasionally send you communications of a transactional nature (e.g., announcements regarding the Service, billing issues, changes to our Services or rules, a welcome email when you first register). You may not opt out of these communications as they are required for us to provide you with our Services.

  1. Your Profile

We process other elements of your account information (such as personal information you provide about your employment, position and marketing preferences), as well as information from public sources, for legitimate purposes, including to personalize your experience and to send you relevant and useful marketing information and recommendations about other products, features and services to enable you (and your organization) to make the best use of our Services.

You may opt out of our collection or use of your information as described above, but if you do so, we may not be able to fully and properly provide you with our Services under certain circumstances.

  1. Concerning your VoD data

We also use Vo Mediasnnaire’s questions and answers in aggregate and anonymous form as described in this Privacy Policy. We will never sell participant response data, nor will we identify or contact individual participants, except at your request or as required by law. If this feature is tied to a feature, this will be specified in the feature descriptions.

3.2. Respondents

We process your personal information in the following categories of data according to our legitimate interests, which are described in detail in this Privacy Policy. We are committed to imposing clearly defined limits on each of these uses in order to ensure that your privacy is respected and that the information is used only for the purpose of achieving these legitimate goals. Our primary objective is to improve our Services and messages and to ensure that they are tailored to the profile of each of our users. We also intend to ensure that the personal information of all users is respected and protected.

  1. Cookies (to include page tags)

We collect information using cookies when you complete a survey. These cookies are used to ensure the optimal and appropriate functioning of our survey service. For more information, please see the section on Cookies below and our Participant Cookie Policy. In most cases, once the survey is completed, you will be redirected to our website and treated as a website visitor where other cookies may be used (if you are interested, you should consult our section on website visitors).

  1. Contact Information

We will only use your contact information to respond to the request we receive from you as a Participant.

For example: our customer service team uses your email address to contact you if you have contacted them regarding a survey, form, application or questionnaire received. However, we will not send you any marketing communications if you have not selected this option in your settings.

  1. Your use of our Services as a Respondent

We use information about your use of our Services in order to improve the services we provide to you and to all users.

For example: we collect information about the types of questions you answer. This data will be aggregated and anonymized to allow us to examine trends in respondents’ preferences when submitting their responses. We collect and use all of this data to serve our legitimate interests, such as helping us improve the respondent experience (to make it easier to answer questions), understanding industry trends in completion rates for VoM/forms and helping to improve them.

  1. Device and Browser Data

We use device data to solve problems encountered with our service and to improve it. We also deduce your geographic location from your IP address.

For example: we collect this to ensure a satisfactory service experience on all possible devices and infer geographic location to produce aggregate data on Respondents’ location trends. We also want to use this information to provide an additional layer of data for Users to filter responses, for example by inferred geographic location. Please note, however, that we do not collect precise GPS location coordinates. We simply infer location from the IP address. Finally, we will use this information to compare and analyze trends in the operation of our service and your interaction with our surveys on different browsers and devices.

  1. Log Data

We use log data for a variety of commercial purposes, including :

  • to monitor abuse and troubleshoot;
  • to create new services, new features, new content, or to make recommendations;
  • to track behavior at the aggregate/anonymous level, and to identify and understand trends in various interactions with our Services;
  • to correct malfunctions in the Services and repair product functionality.
  1. To administer our Services, we will also use your information and data internally for the following purposes:
  • to enforce our agreements where applicable;
  • to prevent potentially illegal activities;

  1. Use of Responses to a Media Advisory

Typically, responses to media channels are controlled and managed by the user of the channel (the person who sent or deployed the channel). In these cases, Vo Medias only processes the responses on behalf of the Creator.

Trust between the User and the Respondent is an essential element of all our activities. Therefore, when we use a Respondent’s data, both Users and Respondents are our priority. If we analyze response data, this analysis is only done once we have ensured the anonymity of individual participants (by aggregating the data and making it anonymous).

Our goal is to improve the user experience with all services, while maintaining the confidentiality and privacy of responses.

Vo Mediasnnaire’s use of data by Vo Medias is discussed in more detail below.

Vo Medias uses the data as described below, in its legitimate interest as specified in this section. The data concerned by this section include :

  • type of Vo Mediasnnaire, type of questions and answers (aggregated and anonymous only) ;
  • device data ;
  • log data.

Vo Medias will use automated processes to analyze survey responses, which will then help us to :

  • Aggregate Response Data and Activity: We aggregate Respondent responses, activity and behavior to identify trends, develop product features to optimize responses, make product recommendations and provide assistance on the most appropriate products and services for different scenarios. These product features also provide feedback and recommendations for improving response rates.
  • Extract and analyze usage patterns: by understanding response data and Respondent interaction with different types of surveys, we can :
    • improve our services and ease of use: for example, we can determine whether Respondents prefer multiple-choice questions or open-ended text entry questions and provide predictive response suggestions when selecting certain types of questions. We can also use this data to improve response analysis;
    • implement customization for both VoM users and respondents;
    • improve the user experience: for example, by collecting and using Respondents’ device and browser information to improve the operation of our service on those devices and browsers;
    • to determine trends in the revealing data (which do not in any way identify individual Respondents).
  1. Visitors

We process your personal data when :

  • You have accepted or ;
  • the legitimate interest of Vo Medias in :
    • improving the service experience ;
    • development of new products and service features.

In each instance where we describe our use of your data in this Privacy Policy, we have identified the basis for our processing of that data.

If you have authorized us to collect and use the following information about you :

  1. Contact information

We use contact information to answer your questions, send you information as part of the Services and to send you marketing communications (if you consent at the time you provide your information, and as long as you have not cancelled this agreement).

For example : we provide your email address to a member of our team who will contact you if you have submitted a question through one of our online forms on our site. In addition, you will receive marketing communications from us if you consented to this at the time you provided your information. At any time, you will be able to opt out of this marketing at any time.

If you do not want Vo Medias to use this information to provide you with targeted advertising for our services, you can indicate your preferences at https://preferences-mgr.truste.com/ or, if you reside in the European Union, at https://www.youronlinechoices.eu/. You may, however, receive advertisements on the Internet that are not associated with the information you have provided to Vo Medias.

The above data that we collect also leads us to do the following in our legitimate interest:

  1. Profiling

We combine information about you from third party sources with information we hold about you to create a user profile, which helps us tailor our advertisements to your profile and customize and improve our marketing campaigns and your website experience.

  1. Machine Learning

For example : We collect aggregate information about the web pages you visit and your activity on our sites. We collect this information to find out which sections of our website are most visited and most useful, in order to identify which services are most popular.

We use referrer information to monitor the effectiveness of our integration and referencing processes.

For example  : if you have clicked on an advertisement for Vo Medias, presented by one of our web partners, that brought you to one of our websites, we will record this information to help us evaluate the effectiveness of our advertising campaigns.

Most of our services allow you to share information with third parties. Please be aware that when you share information publicly, it may be indexed by search engines. Our services provide you with various options for sharing and deleting your content. However, we are not able to remove content from search engines, so please choose carefully what information you make public.

We do not share your information or data with third parties outside Vo Medias, except under the following specific circumstances:

If you are a Vo Mediannaire User using Vo Media as part of an Expert or Enterprise subscription, your account information will be shared with the primary administrator and other members of your team with whom you share your Vo Mediannaires or collaborate will be able to see your respondents’ data. Your organization’s administrators will be able to view your account information, change your passwords, suspend, transfer or terminate your account, or restrict your settings. If you have any questions regarding these topics, please consult your organization’s internal policies.

If your organization has purchased a Corporate account and you use an email address from a domain owned by your employer or organization that is associated with your individual account, you may be asked to migrate to the Corporate account. Once the migration is complete, your email address, name, and account information will be visible to the primary administrator of that account. You may be notified in advance of the migration and have the option to change the email address associated with your account if you are not using your account for business purposes.

We may also need to disclose data for the following purposes:

  • comply with any legal, regulatory, judicial or other applicable request from a public authority ;
  • enforce compliance with applicable rules, including investigating possible violations thereof ;
  • detect, prevent or address fraudulent activity, security breaches or technical problems;
  • protect against any infringement of the rights, property or safety of our users, the public or Vo Media and/or where required or permitted by law.
  • facilitate a sale, merger or transfer of all or part of our business or activity, or the preparation of such events.
  1. Cookies

We and our partners use cookies and similar techniques on our websites.

We use certain cookies, as set out in our Cookie Policy and here in our Privacy Policy, to which you consent when you use our websites and, in the case of certain cookies, to serve the legitimate interest of providing and optimising our services (where the cookie plays a key role in functionality). Cookies are small pieces of binary data that we store on the device you use to access our services so that we can recognize repeat users.

Each cookie expires after a certain period of time, depending on how we use it. We use cookies and other similar technologies for a variety of reasons:

  1. To collect data about your experience

For example, we will collect data on the number of clicks it takes Respondents to complete a Vo Med, whether they left or returned to a survey, whether they skipped parts of a survey and the time it took to answer questions, as well as other survey details. However, this information is collected and stored only in aggregate and anonymous form.

  1. To make our site easier to use

If you use the « Remember me » When you log in to your account, we store your ID in a cookie that will simplify your connection when you return to Vo Medias.

  1. For security reasons

We use cookies to verify your identity and confirm that you are currently logged in to Vo Medias or to determine whether an incident affects your experience.

  1. To provide you with personalized content

We store your user preferences, default language, device, browser, and profile information, including the level of service usage and the web pages on our site that you visit, so that we can identify you on the various devices and customize the content that is offered to you.

  1. To improve our services

We use cookies to measure your use of our websites and track referral data, as well as to offer you different versions of content from time to time. This information helps us to develop and improve our services (it helps us to focus on the parts of the service that seem most relevant to you) and to optimise the content we present to you (this may include marketing content).

  1. Google Analytics

In addition to the above, we have implemented on our websites and other services certain Google Analytics features that support the display of advertisements, including retargeting. Visitors to our websites can unsubscribe from certain types of Google Analytics tracking, customize ads in the Google Display Network using the Google Ad Preferences Manager, and learn how Google displays ads by visiting the Ads Help Center. If you do not wish to participate in Google Analytics, you can also download the Google Analytics Unsubscribe Browser Add-on.

You can delete or disable cookies in your browser settings.

  1. Data Retention

If you have an account with Vo Medias, we do not delete the data from that account; you are responsible for managing the length of time we keep this data. Your account includes controls that allow you to delete data at the account level (all data in your account) and at the response level. If you are a Respondent, you will need to ask the Creator how long your responses will be stored in the Vo Media Services.

  1. Safety for Minors

Our services are not intended for and cannot be used by minors. Minors” are persons under the age of 13 (or below the legal age limit in their country of residence). Vo Medias does not knowingly collect personal data from Minors or allow them to register. If it comes to our attention that we have collected personal information from a Minor, we may delete this information without notice. If you have reason to believe that this has occurred, please contact customer service.

  1. Changes to our Privacy Policy

We may make changes to this Privacy Policy from time to time. We will identify any changes we have made on this page. In the event that a change significantly changes the way we collect or use your information or personal data, we will notify all our account holders of the change.

  1. Personalized marketing

You can unsubscribe from direct marketing from your account; we provide unsubscribe options in all direct marketing emails. Finally, if you do not wish to see personalized marketing content on the Web in connection with our service, you can erase cookies through your browser settings.   1. Who is my data controller?

As mentioned above, all response data at the individual level is managed by the User of Vo Media services.

Vo Media can act as a data controller for the Participants data only according to the techniques described above.

  1. Your rights

You have certain legal rights to inquire whether we hold personal information about you, to access your personal information, and to correct, update, amend or delete it as appropriate. Some of these rights may be subject to certain exceptions or limitations. We will respond to your request to exercise these rights within a reasonable time (in any event, within 30 days of receipt of a request).

  1. For Users

If you are a Vo Media account holder, you are entitled to a copy of any personal data we hold about you. In addition, you have the right to request that we restrict our use of your data or object to certain aspects of our processing of your data. You have access to many of your personal data from your account when you are logged in. However, if you wish to obtain a full copy of all your data or request a restriction/limitation on our use of your data, please contact us at contact here.

Reminder : Vo Medias also allows you to export your own response data from our system in various formats for backup or use with other applications.

  1. For Respondents

If you have responded to a questionnaire, form, quiz or application sent to you by a User, through a Vo Media service, you should contact that person or organization directly to discuss managing, deleting, accessing, limiting access to, or otherwise withdrawing your agreement to the use of the information you provided in your responses.

Vo Medias does not manage your response data and is not in a position to deal directly with such requests in relation to such data. If you have difficulty finding the User in question, you can contact us via our customer support team and we will do our best to help you.

If you wish to exercise any of the above rights in relation to Respondent data described in this policy and for which Vo Medias is the data controller, please contact us.

If you have visited our website and wish to exercise any of the above rights, please contact us. If your request concerns your right to forget only in connection with our use of cookies, you can exercise this right by deleting cookies via your browser settings.
